Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Swatantra Dhakal (“we”, “us”), who operates the TalkTab app and service (“TalkTab”, the “Service”), formerly called FinTrack. By downloading or using TalkTab you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use TalkTab.

1. Who can use TalkTab

You must be at least 18, or the age of majority where you live if that is higher, and able to enter into a binding agreement.

2. What TalkTab is, and what it isn’t

TalkTab is a personal expense tracker. You can record income and expenses by hand, by voice, from a photo, or from a typed note. You can also see your spending in charts and summaries, set spending limits and a savings target, keep monthly recurring charges, and ask questions about your own records.

TalkTab is not a bank, a payment service, a tax preparer, or a financial adviser. It doesn’t connect to your bank, move or hold money, or give financial, investment, tax, accounting, or legal advice. Totals, charts, budgets, answers in Ask, and anything else the app shows are for your own information. Check your own records, and make your own decisions.

3. Your account

  • You can start with a device account, which needs no email, and sign in with Google, Apple, or an email passcode later. A device account can’t be recovered on another phone. If you lose the phone or delete the app before signing in, its records can’t be restored. Sign in to keep your records safe.
  • You are responsible for what happens under your account and for keeping your sign-in secure. You can see and sign out your devices in Settings → Account.
  • Tell us at support@swatantra.dev if you think someone else is using your account.

4. AI features

Voice notes, photos, typed notes, and Ask questions are read by a third-party AI service (Google’s Gemini API), as described in our Privacy Policy. AI can be wrong: it can miss or misread an amount, a date, a category, or a line item, or misunderstand a question. Review every result before you save it or rely on it. You are responsible for the accuracy of the records you keep. We don’t promise that AI results are accurate, complete, or suitable for any purpose.

5. Your content

The records, notes, photos, and other content you add (“Your Content”) belong to you. You give us a limited licence to store, process, transmit, and display Your Content only to run TalkTab for you. That includes syncing it to your devices and sending the items you choose to our AI provider to be read. We don’t use Your Content for advertising or to train AI models. You confirm you have the right to add what you add.

6. Free, and TalkTab Pro

TalkTab is free to use, with unlimited records added by hand and a monthly allowance of AI entries. Each voice note, photo, typed note, or Ask question uses one. TalkTab Pro is an optional auto-renewing subscription with a larger AI allowance and more at once (longer voice notes, more records from one note or photo, and other Pro features shown in the app). The current allowances and features are shown in the app before you buy, and may change over time.

  • Billing. Pro is bought and billed through your Apple App Store or Google Play account. The price is shown in the app before you buy and may differ by country.
  • Free trial. If a plan offers a free trial, you won’t be charged until it ends, and you can cancel before then at no cost. On iOS, any unused part of a free trial ends when you buy a subscription.
  • Auto-renewal. Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. The renewal is charged within the 24 hours before the period ends.
  • Cancelling. Manage or cancel any time in your App Store or Google Play account settings. Deleting the app or your TalkTab account does not cancel a subscription.
  • Refunds. Refunds are handled by Apple or Google under their policies. We can’t issue them ourselves.
  • Price changes. We may change prices for future periods, with notice and, where required, your consent through the store.
  • If Pro ends. Your records stay yours. Features that need Pro stop, and anything Pro-only becomes read-only (for example, a wallet beyond the first).

If you use TalkTab on iOS, Apple’s Standard End User License Agreement also applies, and governs any conflict with these Terms for that use. Apple and Google are not parties to these Terms and are not responsible for TalkTab, but they are third-party beneficiaries who may enforce these Terms against you.

7. Acceptable use

You agree not to:

  • use TalkTab for anything unlawful, or to store unlawful content;
  • reverse engineer or decompile the app, except where the law allows it;
  • interfere with or overload the Service, or get around its allowances or security;
  • access the Service by automated means other than our apps;
  • resell, sublicense, or commercially exploit the Service without our permission.

8. Third-party services

TalkTab relies on other companies’ services (including Apple, Google, RevenueCat, PostHog, Sentry, Resend, ipinfo.io, and our hosting provider), as listed in our Privacy Policy. Their own terms may apply to you, and we aren’t responsible for them.

9. Your data, and backups

TalkTab stores your records on your phone and, when you’re online, on our server. We work to keep them safe, but no service is free of failure. Keep your own copies of anything you can’t afford to lose. To the extent the law allows, we are not responsible for lost data, including records on a device account that was never signed in.

10. Disclaimers

TalkTab is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don’t promise that the Service will be uninterrupted, error-free, or secure, or that what it shows (including AI results and calculated totals) is accurate.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of TalkTab. Our total liability for any claim about the Service is limited to the greater of what you paid us in the 12 months before the claim and USD 50. Some places don’t allow these limits, so they may not all apply to you.

12. Indemnity

To the extent the law allows, you agree to cover our losses and costs from claims caused by your misuse of TalkTab, Your Content, or your breach of these Terms.

13. Ending your use

You can stop using TalkTab and delete your account at any time (Settings → tap your profile → Account → Delete account). How we handle your data then is described in Section 9 of our Privacy Policy. We may suspend or end your access if you break these Terms, or to protect the Service or other people. Sections that should naturally continue after that (ownership, disclaimers, liability, governing law) continue.

14. Governing law

These Terms are governed by the laws of Nepal, without regard to conflict-of-laws rules, and disputes go to the courts of Nepal. This doesn’t take away the consumer protections of the country you live in (for example, consumers in the EU/EEA and UK keep the protection of their local law), or any rights you have under the App Store or Google Play terms.

15. Changes to these Terms

If we change these Terms, we’ll update the “Last updated” date above, and for important changes we’ll tell you in the app before they take effect. If you keep using TalkTab after that, the new Terms apply.
