Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Swatantra Dhakal (“we”, “us”), operator of the FinTrack app and service (“FinTrack”, the “Service”). By downloading, accessing, or using FinTrack, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract. FinTrack is not intended for children.

2. The Service

FinTrack is a personal-finance tracking tool that lets you record income and expenses, categorize them, attach receipts, set recurring entries, and add transactions by manual entry, voice, or receipt photo using AI-assisted extraction.

FinTrack is not a bank, financial institution, tax preparer, or financial adviser. It does not move money, hold funds, or provide financial, investment, tax, accounting, or legal advice. Any totals, categorizations, or insights are for your personal information only. You are responsible for verifying your own records and for any financial decisions you make.

3. Your account

• You are responsible for activity under your account and for keeping your sign-in method secure.
• You may sign in using a device account, Google, Apple, or email one-time passcode.
• You must provide accurate information and keep it current.
• Notify us at support@swatantra.dev if you suspect unauthorized use.

4. AI features and accuracy

Voice and receipt features use a third-party AI provider (Google’s Gemini API) to extract transaction details. AI output can be incomplete or wrong. You must review and confirm every AI-extracted entry before relying on it. We make no warranty that AI extraction is accurate, complete, or fit for any purpose. You are responsible for the accuracy of the data you save.

5. Your content

You retain ownership of the transactions, notes, images, and other content you add (“Your Content”). You grant us a limited, non-exclusive license to host, store, process, transmit, and display Your Content solely to operate and provide the Service to you (including sending voice/images to our AI provider for extraction and syncing your data across your devices). We do not use Your Content to train our own models or for advertising.

You are responsible for Your Content and confirm you have the right to submit it.

6. FinTrack Pro subscription

FinTrack offers a free tier and an optional auto-renewable subscription (“FinTrack Pro”) that unlocks higher voice/AI usage limits and other premium features.

• Billing: Subscriptions are purchased and billed through your Apple App Store or Google Play account, managed by RevenueCat. Prices are shown in the app before purchase and may vary by region.
• Auto-renewal: Your subscription automatically renews at the end of each period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the period.
• Managing / cancelling: Manage or cancel anytime in your App Store or Google Play account settings. Deleting the app does not cancel your subscription.
• Free-tier limits: The free tier includes a monthly quota of AI voice entries that varies by market. Quotas may change over time.
• Refunds: Purchases are handled by Apple/Google and are subject to their refund policies. We generally cannot issue refunds directly.
• Price changes: We may change subscription pricing; changes apply to future periods and, where required, only after notice and/or your consent.

If you are on iOS, the Apple Standard EULA (Licensed Application End User License Agreement) also applies to your use of the app; where it conflicts with these Terms for iOS use, the Apple Standard EULA governs that conflict. Apple and Google are not parties to these Terms and are not responsible for the Service, but are third-party beneficiaries entitled to enforce them against you.

7. Acceptable use

You agree not to:

• Use the Service for anything unlawful, or to store unlawful content.
• Reverse engineer, decompile, or attempt to extract source code, except as permitted by law.
• Interfere with, overload, or disrupt the Service or its infrastructure, or circumvent usage limits or security.
• Access the Service through automated means except our provided app.
• Resell, sublicense, or commercially exploit the Service without our permission.

8. Third-party services

FinTrack relies on third-party services (Apple, Google, RevenueCat, Sentry, Resend, and our hosting providers). Your use of those services may be subject to their terms. We are not responsible for third-party services.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data (including AI extractions) will be accurate. You use the Service at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnity

You agree to indemnify and hold us harmless from claims and expenses arising from your misuse of the Service, Your Content, or your breach of these Terms, to the extent permitted by law.

12. Termination

You may stop using the Service and delete your account at any time (Settings → Delete Account). We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive termination (e.g. ownership, disclaimers, liability, governing law) survive.

13. Governing law and disputes

These Terms are governed by the laws of Nepal, without regard to conflict-of-laws rules, and disputes are subject to the courts located in Nepal. Nothing in this section deprives you of the mandatory consumer-protection rights of your country of residence (for example, consumers in the EU/EEA and UK retain the protections of their local law). Nothing limits rights you may have under the Apple App Store or Google Play terms.

14. Changes to these Terms

We may update these Terms. Material changes will be indicated by the “Last updated” date and, where appropriate, in-app notice. Continued use after changes means you accept the updated Terms.
